i have recently been notified that i am running a pirate copy ov xp pro which was with the computer when i bought it i have noticed i have a badge with a product code on the back of the tower for windows xp home with prod key any1 no were can get a copy ov xp home

You need to contact the people that sold you the computer and ask them... What's up? If they don't make good on their software then report them to microsoft and the BBB. Unfortunately, if they don't make good then you'll have to buy a copy.

You might contact Microsoft and tell them your product key # and ask for a CD ,they generally will send you one for a small fee, btw who notified you that you had a (pirated ) version .....

tryed to install service pack2 and was error note saying i had a pirated copy thanks for the replys anyway easier to just pop to the shop and get new disc

If you think the product code on the side of the pc is correct you can try changing your product key. Follow these instructions

does it not matter that my os is xp pro and the prod key is for xp home

Yes it does matter. In that case, if you don't have the right product key for pro, then you'll have to go pick up a disc.
